Because he knew the FISA judges would NOT allow him to spy on domestic political enemies such as:
Those evil Quakers
Those evil peace activists
Those evil emeritus professors of Asian history
Those evil Democrats
Those evil Dewars at the UN
In short, Bush broke the law, because the law wouldn't allow him to spy on political enemies.
